OFFICIAL CONTEST RULES AND REGULATIONS
PROMOTION PERIOD:
The Scratch & Scrap Promotion (the “Promotion”) operates during normal store hours at participating AIM Recycling locations in Ontario and across the USA (See https://www.AIM-Recycling.com or https://www.aim-recyclingca.com for a complete list of “Participating Locations”). The Promotion begins on September 18, 2023 and is scheduled to end on February 29, 2024, or when official Scratch Card supplies are exhausted (whichever occurs first) (the “Promotion Period”).
ELIGIBILITY:
Promotion is only open to residents of Ontario, Erie, Phoenix and California (excluding residents of Quebec) who have reached the legal age of majority in their state/province/territory of residence at the time of entry. Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of American Iron & Metal Company Inc. (the “Sponsor”) and each of its associated and affiliated entities, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfillment of the Promotion (collectively with the Sponsor, the “Promotion Parties”) are not eligible to participate. By participating, you agree to be legally bound by the terms and conditions of these Official Contest Rules and Regulations (the “Rules”).
HOW TO ENTER:
During the Promotion Period, eligible participants can receive one (1) Scratch Card (each, a “Scratch Card”), while supplies last, in-store at a Participating Location. There is no cost associated with obtaining a Scratch Card. The Scratch Card will be provided by a representative at the Participating Location immediately following their transaction and will contain one (1) scratch area revealing the prize notification. To participate, eligible entrants must scratch where indicated on the Scratch Card and must scratch only in the presence of a representative at the Participating Location where the Scratch Card was obtained. If any part of the scratch area on the Scratch Card is revealed prior to being scratched in front of a representative at a Participating Location, the Scratch Card will be considered null and void. NO PURCHASE NECESSARY. ATHOUGH THE SCRATCH CARD MUST BE SCRATCHED IN THE PRESENCE OF A REPRESENTATIVE AT A PARTICIPATING LOCATION, THERE IS NO OBLIGATION TO COMPLETE ANY PURCHASE TRANSACTION.
At the start of the Promotion, there will be a total of 80,000 Scratch Cards available for distribution at Participating Locations. At the start of the Promotion, each Participating Location will receive a predetermined number of randomly selected Scratch Cards that will be available for distribution at that Participating Location during the Promotion Period, while supplies last. There is a limit of one (1) Scratch Card permitted per person, per visit to a Participating Location. If it is discovered that any person has attempted to obtain more than one (1) Scratch Card per person, per visit to a Participating Location by any means, then they may be disqualified (in the sole and absolute discretion of the Sponsor) and, if disqualified, their Scratch Card will be considered null and void. All Scratch Cards are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Promotion; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Scratch Card and/or information entered (or purportedly entered) for the purposes of this Promotion; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Promotion in accordance with the Sponsor’s interpretation of letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Promotion will be the Sponsor’s official time-keeping device(s).
Each Scratch Card can only be used one (1) time. Each Scratch Card will become void after its first use or at close of business at the Participating Location on February 29, 2024 (whichever occurs first). Any Scratch Card that cannot be verified to the complete satisfaction of the Sponsor (or, as applicable, the Sponsor’s designated representative), in its sole and absolute discretion, is subject to immediate disqualification (in which case the rights to any Prize associated with such Scratch Card will be forfeited in their entirety).
If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) Scratch Card per person, per Participating Location; (ii) use multiple names, multiple identities, and/or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Rules to enter or otherwise participate in or to disrupt this Promotion; (ii) falsely claim a Scratch Card without legitimately obtaining an eligible Scratch Card in accordance with these Rules; and/or (iii) submit or attempt to submit a Scratch Card that has been falsified, manipulated or otherwise altered in any way (all as determined by Sponsor in its sole and absolute discretion); then they may be disqualified from the Promotion in the sole and absolute discretion of the Sponsor. The Promotion Parties and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed or incomplete information (all of which is void). Without limiting the generality of the foregoing, photocopies and/or other reproductions of Scratch Cards are strictly prohibited and will not be accepted.
THE PRIZES AND ODDS:
Each Scratch Card will reveal one (1) of the following discounts: (i) + $10 / ton, Autocast; (ii) + $0.05 / lb, Alum Mixed; (iii) + $0.03 / lb, Copper #1B; (iv) + $0.05 / lb, Copper #2; (v) + $10 / ton, Tin/Tole; (vi) free branded merchandise or promotional materials (each a “Prize” or “added value”). All amounts are in Participating Location’s legal currency. At the start of the Promotion, the number of Scratch Cards available and the odds of obtaining a particular Scratch Card are as follows:

The odds of obtaining a particular Scratch Card will vary based on distribution of Scratch Cards by Sponsor to Participating Locations and will change throughout the Promotion Period as Scratch Cards are distributed and redeemed. The total number and particular quantities of Prizes available to be won will decrease as Scratch Cards are distributed and Prizes are claimed.
If due to printing, production, online, internet, computer or other error of any kind, more Prizes are claimed than intended to be distributed or awarded according to these Rules, then, in addition to having the right to terminate the Promotion immediately, the Sponsor reserves the right, in its sole and absolute discretion, to rescind invalid Prize claims and/or conduct a random draw from amongst all eligible claimants to award the correct number and type of Prizes as specified in these Rules. In no event whatsoever will the Sponsor or any of the other Released Parties be liable for more than the number, type and value of Prizes as stated in these Rules.
Prizes must be accepted as awarded, are non-exchangeable, non-transferable, non-assignable and not redeemable for cash. No substitutions are permitted, except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize with a prize of equal or greater value. Added Values are valid at Participating Locations only and cannot be redeemed online. Added Values apply only to commodities noted. Added Values have no cash surrender or other value. Added Values are not valid on prior transactions. Certain conditions may apply.
WINNER CONFIRMATION PROCESS
NO ONE IS A PRIZE WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS THEM AS A PRIZE WINNER IN ACCORDANCE WITH THESE RULES. BEFORE BEING CONFIRMED AS A PRIZE WINNER, each eligible Prize winner will be required to correctly answer the mathematical skill-testing question (without mechanical or other aid) as identified on the Scratch Card and present it to a representative at the Participating Location. By participating, you hereby: (i) confirm compliance with these Rules; (ii) acknowledge acceptance of the applicable Prize (as awarded); and (iii) release the Sponsor and all of the other Released Parties from any and all liability in connection with this Promotion, your participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof. If you: (a) fail to correctly answer the skill-testing question; (b) cannot accept (or are unwilling to accept) the applicable Prize (as awarded) for any reason; and/or (c) are determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then you may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and the corresponding Prize will not be available to be won in this Promotion.
GENERAL CONDITIONS
All Scratch Cards become the property of the Sponsor. This Promotion is subject to all applicable federal, provincial and municipal laws. Void in Quebec and where prohibited or restricted by law. The decisions of the Sponsor with respect to all aspects of this Promotion are final and binding on all entrants without right of appeal. The Released Parties will not be liable for the failure of any individual to receive a Scratch Card. The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Promotion (or to amend these Rules) in any way, in the event of any error, tampering, unauthorized intervention, fraud, or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Promotion as contemplated by these Rules. Any attempt to deliberately undermine the legitimate operation of this Promotion in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and/or civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Promotion, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.
ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
By participating in this Promotion, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Promotion and in accordance with the Sponsor’s privacy policy (available at: aim-recycling.com and aim-recyclingca.com). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
The Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for purposes of verifying compliance by any entrant and/or any other information or materials with these Rules, or as a result of any problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Promotion as contemplated in these Rules, or for any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Promotion-related materials, including, but not limited to, any website(s), point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.
The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Promotion will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario, Erie, Phoenix, or California in any action to enforce (or otherwise relating to) these Rules or relating to this Promotion.
